Sole Proprietor Ostapuk Roman Hryhorovych (hereinafter referred to as the "Seller"), acting under the current legislation of Ukraine, offers to enter into this Public Offer Agreement for the sale and purchase of books via the Website https://throughukrainianeyes.org/ (hereinafter referred to as the "Agreement").

This Agreement is public and, in accordance with Articles 633 and 641 of the Civil Code of Ukraine, its terms are the same for all consumers. Unconditional acceptance of the terms of this Agreement (payment by any available means) is considered acceptance of this Agreement between the Buyer and the Seller, signifying the fact of its conclusion.

1. DEFINITIONS

1.1. Website – an online site located at https://throughukrainianeyes.org/.

1.2. Buyer – a legally capable individual or legal entity who has placed an Order on the Website. By accepting the terms of this offer, the Buyer confirms that they are a competent citizen, an individual entrepreneur, or a representative of an active legal entity, with the necessary documents to make this transaction.

1.3. Book – a tangible item, printed publication containing text and/or graphic materials intended for the transfer of knowledge, ideas, information, etc., which is an object of copyright and is protected by law.

1.4. End Consumer – an individual who purchases the Book from the Seller as the final consumer.

1.5. Product – a book presented for sale on the Website.

2. SUBJECT OF THE AGREEMENT

2.1. Under this Agreement, the Seller transfers the Product to the Buyer on the terms specified herein, and the Buyer accepts and pays for it according to the conditions stipulated in this Agreement.

2.2. By agreeing to the terms of this Agreement, the Buyer confirms that they have familiarized themselves with all of its clauses and with the information posted on the Website.

3. ORDER PLACEMENT PROCEDURE

3.1. The Buyer selects the Product by reviewing the information about it posted on the Website.

3.2. The Product Order is placed by clicking the "Buy," "Add to Cart," or "Place Order" button on the Website.

3.3. During the order process, the Buyer provides the following personal information:

• full name;
• contact phone number;
• email address;
• postal address (for delivery purposes).

3.4. The Buyer confirms the accuracy of the provided information and accepts responsibility for its correctness.

4. PAYMENT AND DELIVERY PROCEDURE

4.1. The total order cost includes the Product price (as specified on the Website) and delivery costs (if applicable).

4.2. Payment for the Product is made by the Buyer exclusively on the terms of full prepayment, which is considered acceptance of this Agreement.

4.3. After placing the order, the Buyer proceeds to the payment page to complete payment according to the instructions provided on the Website.

4.4. The payment date is considered the date the funds are credited to the Seller's account.

4.5. Product delivery: the Product is delivered to the address specified by the Buyer within the timeframe indicated on the Website, following payment confirmation.

5. LIABILITY OF THE PARTIES

5.1. The Parties are responsible for failure or improper fulfillment of their obligations in accordance with the current legislation of Ukraine.

6. CONFIDENTIALITY

6.1. All information obtained by the Parties in connection with the execution of this Agreement is confidential and may not be disclosed to third parties without the consent of the other Party, except in cases provided by law.

6.2. The Parties guarantee compliance with the Law of Ukraine "On Personal Data Protection."

7. DISPUTE RESOLUTION

7.1. All disputes related to this Agreement shall be resolved through negotiations between the Parties.

7.2. If the dispute cannot be resolved through negotiations, it shall be resolved in court in accordance with the current legislation of Ukraine.

8. PRODUCT RETURN AND EXCHANGE

8.1. Products of proper quality are non-returnable and non-exchangeable in accordance with the Law of Ukraine "On Consumer Rights Protection."

8.2. Claims regarding products of inadequate quality:

• A Product of inadequate quality is one that cannot fulfill its functional qualities.
• The received Product must match the description on the Website. A Product whose design elements or appearance differ from the description on the Website is not considered inadequate.
• The appearance, assortment, and completeness of the entire order should be checked by the Buyer at the time of receipt. Claims about external defects, quantity, assortment, or appearance of the Product after receiving the order will not be accepted.
• If the Buyer is delivered a Product of inadequate quality, they have the right to request a replacement by preparing a relevant act when receiving the Product from the delivery service.

8.3. The refund is processed within 10 banking days following a positive decision from the quality examination (recognition of the Product's quality as inadequate) to the Buyer's bank account or by another agreed method.

9. FORCE MAJEURE

9.1. The Parties are exempt from liability for failure or improper performance of obligations under the Agreement during the period of force majeure.

10. DURATION OF THE AGREEMENT

10.1. This Agreement comes into force from the moment the Order is placed and terminates upon full fulfillment of obligations by the Parties.

11. PERSONAL DATA

11.1. The Seller collects and processes the Buyer's personal data for the purpose of fulfilling this Agreement and delivering the ordered Product.
